Terms of Service

1. The service
PedestalShot lets you upload photos of products you sell and generates AI-staged marketing images from them using Google's Gemini image models. We may add related AI features, such as short AI presenter videos, that will be covered by these Terms once launched. The service is intended for commercial use by sellers, agencies, and marketers.
2. Eligibility and your account
You must be at least 18 years old and able to enter a binding contract to use PedestalShot. You're responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.
3. Your content and the license you grant us
You keep ownership of every photo you upload. By uploading, you confirm you own the product shown, or otherwise hold the rights needed for us to use, reproduce, and create AI-generated images from it for your commercial marketing purposes. You grant us a limited, non-exclusive license to store, process, and transmit your uploads — including sending them to our AI provider — solely to operate the service and generate images for you.
4. Your rights in generated images
For every image generated using your paid or granted credits, we grant you a worldwide, perpetual license to use the result for any commercial purpose, including the right to reproduce, modify, advertise, publish, and sell products using it. To the extent we hold any intellectual-property rights in that generated result, we assign those rights to you. This grant doesn't change your ownership of your own product, brand, or trademarks, which remain yours exactly as before.
5. What this grant doesn't guarantee
Copyright protection for AI-generated images is unsettled and doesn't exist in every jurisdiction, so we can't guarantee that a given output is protectable by copyright, or that our assignment conveys any right at all if none exists to assign in the first place. We also can't guarantee exclusivity: because outputs are AI-generated, another user, including someone using a similar photo or scene, could end up with a similar or identical result. Our assignment covers only whatever rights we actually hold — it isn't a warranty of registrability, originality, or exclusivity.
6. AI output is variable — review before you publish
Generated images are produced by AI models and are not guaranteed to be identical to your product on every run. Outputs can contain distortions, inaccuracies, altered text, incorrect colors, or other artifacts. You're responsible for reviewing every output for product fidelity before publishing or using it commercially, and we don't warrant that outputs are exact representations of your product.
7. No marketplace or legal compliance guarantee
We don't guarantee that generated images comply with the image policies of any marketplace or advertising platform, or with advertising, consumer-protection, or other laws in your jurisdiction. Confirming that outputs meet the rules of the platforms and locations where you use them is your responsibility.
8. People in generated scenes
Scenes that include people show entirely fictional, AI-generated adults. The service is not designed to use or recreate the likeness of any real person, and you may not attempt to generate images depicting a real, identifiable person.
9. Prohibited content and conduct
You agree not to upload, or attempt to generate, content you don't own or aren't authorized to use; images of real people without their consent, or of any minor; nudity or sexually explicit material; violent or hateful content; or products that are illegal, counterfeit, or infringe someone else's intellectual property. Full detail is set out in the Acceptable Use Policy, which is part of these Terms.
10. Credits
Access to generation is metered in credits, tracked in an internal, append-only ledger. New accounts receive a one-time signup grant of 15 credits after email verification. Monthly subscription plans grant a credit allotment each billing period; those credits expire at the end of the billing period in which they were granted and don't carry over. Credits purchased as one-time top-ups don't expire.
11. Billing and subscriptions
Payments and subscription billing are processed by Stripe; we never receive or store your card details. Monthly plans ($19, $49, and $99) renew automatically each billing period until you cancel. You can manage your subscription, cancel it, or buy top-up credits through the billing portal. Prices are shown before purchase and may change on notice for future billing periods.
12. Refunds and payment disputes
Refunds are issued as compensating entries in your credit ledger rather than by rewriting ledger history. If credits related to a refund have already been spent, your available balance can go negative, which blocks new generations until the balance is resolved. We don't automatically refund credits because you dislike an output, but you can report a problematic output for review. Chargebacks and payment disputes result in account restrictions while the dispute is resolved.
13. Account restrictions and termination
We may restrict, suspend, or terminate accounts that violate these Terms or the Acceptable Use Policy, that trigger abuse signals such as repeated provider safety blocks or payment disputes, or as needed to protect the service and other users. You may delete your account at any time; access is revoked immediately, and your stored content and personal data are scheduled for deletion subject to the financial and audit retention requirements described in our Privacy Policy.
14. Our intellectual property
Apart from your uploaded and generated images, the PedestalShot service, software, and branding are owned by Pedestal Shot and aren't licensed to you beyond what's needed to use the service.
15. Disclaimer of warranties
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service or its outputs will be uninterrupted, error-free, or suitable for any specific commercial or legal use.
16. Limitation of liability
To the maximum extent permitted by law, Pedestal Shot is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.
17. Indemnification
You agree to defend and indemnify Pedestal Shot against claims, damages, and expenses arising from content you upload, your use of generated outputs, or your violation of these Terms or applicable law.
18. Governing law
These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-law principles. [Dispute-resolution mechanism, such as arbitration or venue, to be finalized after legal review.]
19. Changes to these Terms
We may update these Terms as the service evolves. We'll update the "Last updated" date above, and for material changes we'll make a reasonable effort to notify active account holders before they take effect. Continuing to use the service after changes take effect means you accept the updated Terms.
